LEGISLATIVE UPDATE  
 
The 2019 Session of the NH Legislature has begun. Committees are beginning public hearings on proposed bills, and the House Finance Committee is doing preparation work in advance of the next biennial state budget. 
 
With a flip of control in the House and the Senate it will be interesting to see the dynamics. We've been made aware of several bills that could impact OHRV trails/access in 2019 for area businesses. First let's look at some of the positive impacts of the OHRV trails.

The following proposed bills will drastically change the FUTURE of OHRV riding in N.H. We ask that all residents and businesses of N.H. to please call your local Representatives and encourage them to Oppose and Support the following Bills.

Please use courtesy when communicating with them as it is a reflection
upon our sport. We need everyone’s help to keep the future alive. Call,
Write and interact with your local representatives, then attend the
hearings to show a united force to maintain the current use and economic impact that has come with this viable NH recreational interest!

Bills New Hampshire Off-High Vehicle Association oppose:

Bill: HB 498
Title: prohibiting OHRV operation on class v ways.
Sponsor: Rep. Wayne Moynihan
Committee: House Transportation
Status: Schedule pending.
Comments: Bill would ban OHRVs from Class V roads and impose other restrictions.

Bill: HB 683
Title: relative to the rights of property owners abutting certain highways and rail trails.
Sponsor: Rep. Wayne Moynihan
Committee: House Resources, Recreation and Development
Status: Schedule pending.
Comments: NHOHVA strongly opposes. Bill would shut down riding and result in lawsuits
and other chaos.

Bill: HB 699
Title: relative to discounts for OHRV and snowmobile registration.
Sponsor: Rep. James Spillane
Committee: House Fish and Game and Marine Resources
Status: Schedule pending.
Comments: Bill would repeal club incentive programs for OHRVs and snowmobiles. NHOHVA
and NHSA strongly oppose.

Bill: HB 592
Title: relative to OHRV operation and license.
Sponsor: Rep. Wayne Moynihan
Committee: House Transportation
Status: Schedule pending.
Comments: Age restriction bill. Riders using roadways must have a driver's license. NHOHVA
opposed in past two years and will oppose this year.

Bill: HB 660
Title: relative to studying the economic and other impacts of OHRV use in New
Hampshire.
Sponsor: Rep. Wayne Moynihan
Committee: House Resources, Recreation and Development
Status: Schedule pending.
Comments: Bill appears to use all GIA money to fund study. We would not support that.

Below is the bills NHOHVA support. We will probably NOT
need letters or testimony on these. Some are bills we are not
yet sure about, but will watch and notify stakeholders.

Bill: HB 591
Title: amending the laws governing OHRVs and snowmobiles.
Sponsor: Rep. Wayne Moynihan

Comments: Request of Fish & Game. Pertains mainly to safety and related concerns.
NHOHVA generally okay with it.

Bill: HB 630
Title: increasing certain fines for OHRV and snowmobile operation violations.

Status: Schedule pending.
Comments: Bill targets “rogue” riders and other problem children. NHOHVA supports.

Bill: HB 639
Title: relative to speed limits in cities and towns.
Sponsor: Rep. Jacqueline Cali-Pitts

Status: Schedule pending.
Comments: Appears to be aimed at motor vehicles, but a speed limit is a speed limit. RYP will
monitor.

Bill: SB 39
Title: relative to the repair of roads not maintained by a municipality.

Title: establishing a rail trail corridors advisory committee to assist the department of
transportation in updating the state trails plan and making an appropriation
therefor.

Comments: NHOHVA would likely support. Need more info.

Title: establishing the position of director of the office of outdoor recreation industry
development in the department of business and economic affairs.
